The terms that govern your use of the TAP Academy website, applications, Learning Management System and related services, including your rights, responsibilities and how disputes are handled.

Overview

The Services are provided by Tap Edtech Pvt Ltd, a company incorporated under the Companies Act, 1956, with its corporate office at BTM Layout 2nd Stage, Bengaluru, Karnataka 560076. In these Terms, “Tap Edtech Pvt Ltd”, “we”, “us” and “our” refer to the company.

These Terms govern your use of:

  • The Tap Edtech Pvt Ltd website
  • Applications
  • The Learning Management System
  • Other products and services

Together, these are the “Services.” Some Services may include software downloaded to your computer, phone, tablet or other device. You agree that we may automatically update this software, and that these Terms apply to those updates.

The Terms, and the policies they reference, form a binding contract between you and Tap Edtech Pvt Ltd. You accept them by:

  • Clicking or tapping an acceptance button
  • Executing a document that references the Terms
  • Using the Services

Terms of Services

Registration & Information

You don't need to register merely to visit and view the website. Accessing the offered Services requires creating a password-protected account.

During registration, we may request personal information such as:

  • Name
  • Age
  • Gender
  • Mobile-device information
  • Location
  • Other registration details

You agree that all submitted information will remain true, accurate, current and complete, and that you will update it whenever necessary.

By sharing your email address or phone number, you consent to being contacted about upcoming events, program updates and deadlines through:

  • Phone calls
  • SMS notifications
  • Mobile applications
  • Email
  • Other electronic communication methods

Account Security

You are responsible for:

  • Protecting your passwords
  • Keeping your passwords secure
  • All activity conducted through your account
  • Immediately reporting security breaches or unauthorized use

You may not:

  • Use another person's account without permission
  • Misrepresent your identity
  • Pretend to be another user

You may be liable for direct or indirect losses, damages and expenses caused by unauthorized use of your account, including losses incurred by Tap Edtech Pvt Ltd or other people.

User Content

“User Content”

The Services allow you to submit or share material such as:

  • Homework
  • Quizzes
  • Exams
  • Projects
  • Assignments
  • Forum posts
  • Similar content

You retain intellectual-property rights in your User Content and remain responsible for it. Tap Edtech Pvt Ltd is not responsible for your actions concerning User Content, including making it public.

You may not use another person's User Content without that person's express permission.

How We and Others May Use User Content

When you provide User Content, you grant Tap Edtech Pvt Ltd a fully transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide licence to:

  • Copy the content
  • Distribute it
  • Modify it
  • Create derivative works
  • Publicly perform it
  • Publicly display it
  • Otherwise use it

The licence includes the right to authorize institutions offering courses through the Services to use User Content with registered students and on-campus learners outside the Services. The licence continues after you stop using the Services.

Tap Edtech Pvt Ltd reserves the right to remove or modify User Content for any reason, including suspected violations of these Terms. The company disclaims responsibility for unauthorized use of User Content by instructors or other users, including losses caused by misuse or intellectual-property infringement.

Feedback

You may submit suggestions, ideas, comments and other feedback. By doing so, you grant Tap Edtech Pvt Ltd the right to use it without restriction and without compensation.

Accepting feedback does not waive our right to use similar ideas that were:

  • Previously known
  • Independently developed by employees or contractors
  • Obtained from another source

Security

Tap Edtech Pvt Ltd works to protect your account and related information, but cannot guarantee that unauthorized third parties will never defeat its security measures.

Please report immediately:

  • Compromised accounts
  • Unauthorized account use
  • Other security incidents

Third-Party Content

The Services may provide access to:

  • Instructor content
  • Content from other users
  • Third-party content
  • Third-party websites and services

We do not guarantee that third-party content will be free from:

  • Objectionable or inappropriate material
  • Malware
  • Other harmful contaminants

The company disclaims responsibility for access to or use of third-party content. Tap Edtech Pvt Ltd does not have a principal-agent or employer-employee relationship with instructors, users or third parties, and does not accept liability on their behalf.

Education Research

Tap Edtech Pvt Ltd may use records of participation in courses for education research. Research findings will generally be reported in aggregate form; personal identities will not be publicly disclosed in research findings without express consent.

Modifying & Terminating Services

Tap Edtech Pvt Ltd may:

  • Add or remove functions and features
  • Change requirements
  • Suspend Services
  • Discontinue Services
  • Terminate your access for any reason

If access to a paid Service is terminated, a refund may be considered individually and remains entirely at Tap Edtech Pvt Ltd's discretion. The company, its directors, instructors, contributors, sponsors, business partners, employees, officers, staff, contractors and agents disclaim liability for such action. You may stop using the Services at any time.

Disclaimers

The Services and included content are supplied on an “as is” basis, without express or implied warranties.

Tap Edtech Pvt Ltd disclaims warranties and conditions relating to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Course of dealing
  • Usage of trade

The company also disclaims liability connected with accessing or using the Services or related content. You acknowledge that access to and use of the Services are at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Tap Edtech Pvt Ltd and its related parties will not be liable for:

  • Indirect damages
  • Incidental damages
  • Special damages
  • Consequential damages
  • Punitive damages
  • Lost profits
  • Lost revenue
  • Lost business opportunities
  • Loss of data
  • Loss of use
  • Loss of goodwill
  • Other intangible losses

This limitation applies to claims arising from:

  • 1.Accessing, using or being unable to access or use the Services.
  • 2.Conduct or content from another party, including defamatory, offensive or illegal conduct.
  • 3.Unauthorized access to, use of or alteration of content or information.
  • 4.The Terms themselves.
  • 5.An act, omission or negligence to which you contributed.

Tap Edtech Pvt Ltd's aggregate liability for all Service-related claims is limited to ₹1,000. These limitations reflect a fair allocation of risk and are essential to providing the Services on an economically feasible basis.

A cause of action connected with the Services must begin within one year of arising; otherwise, it is permanently barred.

12.

Indemnification

You agree to indemnify, defend and hold harmless Tap Edtech Pvt Ltd and its related parties against third-party claims, liabilities, expenses and damages, including reasonable legal fees and costs, arising from:

  • Use or attempted use of the Services in violation of the Terms
  • Violation of a law
  • Violation of a third party's rights
  • User Content
  • Intellectual-property infringement
  • Misappropriation of proprietary rights
13.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Karnataka, excluding conflict-of-law provisions. You consent to personal jurisdiction in Karnataka and exclusive venue in the national and state courts serving Karnataka.

Except for requests for injunctive or equitable relief, either party may elect to resolve a dispute through binding, non-appearance-based arbitration, on these conditions:

  • A mutually agreed alternative dispute-resolution provider is used
  • No personal appearance by parties or witnesses, unless mutually agreed
  • Proceedings are conducted online, by telephone or through written submissions
  • The resulting judgment may be entered in a court with appropriate jurisdiction
14.

Revisions to the Terms

Tap Edtech Pvt Ltd may revise the Terms at its sole discretion at any time. Changes become effective immediately after publication.

Continued use of the Services after changes are published constitutes binding acceptance, whether or not you receive a separate notification.

15.

Severability & Waiver

If a provision of these Terms is found unenforceable, the remaining provisions continue to apply. A delay or failure by Tap Edtech Pvt Ltd to enforce a provision does not mean it has waived its rights or cannot act later.

Acceptable Use Policy

Prohibited Content

You may not use the Services to share content that:

  • Is illegal or promotes illegal activities
  • Is inappropriate for younger learners, including users as young as 13
  • Contains credible threats
  • Organizes or encourages real-world violence
  • Creates a genuine risk of physical injury or property damage
  • Threatens people or public safety
  • Harasses others
  • Abuses private individuals
  • Violates intellectual-property, privacy or other rights
  • Uses material without permission
  • Falsely claims ownership of another person's work
  • Contains spam
  • Includes irrelevant or inappropriate advertising, promotions or solicitations
  • Otherwise violates the Terms

Attribute quoted or reused materials to the original copyright owner. Specific courses may impose additional rules and requirements.

Prohibited Conduct

You may not:

  • Violate local, state, national or international law
  • Breach contractual or fiduciary obligations
  • Share passwords
  • Allow another person to access your account
  • Put an account at risk
  • Attempt to access another user's account
  • Reproduce, transfer, sell, resell or misuse Service content without authorization
  • Access, tamper with or use non-public areas of company systems without authorization
  • Circumvent authentication or security measures
  • Test system or network vulnerabilities without authorization
  • Reverse engineer any portion of the Services
  • Interfere with a user, host or network
  • Send viruses
  • Overload systems
  • Spam or mail-bomb systems or users
  • Distribute malware
  • Impersonate another person or entity
  • Misrepresent an affiliation
  • Encourage or assist another person in committing a prohibited act
18.

Privacy

Use of the Services constitutes agreement to the TAP Academy Privacy Policy, which forms part of these Terms. It governs the personal and financial information Tap Edtech Pvt Ltd collects from you, receives from you, or processes through the website and Services. You consent to this processing and warrant that the information you provide is accurate.

19.

Force Majeure

Neither party is liable for delay or failure to perform an obligation, other than payment obligations, when caused by events beyond its control and without fault or negligence.

Examples include:

  • Fires
  • Floods
  • Earthquakes
  • Strikes
  • Unavailable utilities
  • Blackouts
  • Acts of God
  • Declared or undeclared war
  • Acts of regulatory agencies
  • National disasters
20.

Electronic Communications & Marketing Consent

Tap Edtech Pvt Ltd retains records of voluntarily submitted emails so that it can respond. Information is collected when you register on the website or complete a form; forms may request your name, email address and phone number. You may also visit the site anonymously.

When you submit personal and contact information, Tap Edtech Pvt Ltd reserves the right to contact you through calls, SMS, email and WhatsApp about products and offers, including when your number has Do Not Disturb activated.

21.

Grievance Redressal

Grievances and discrepancies concerning information providers will be addressed within one month (30 days) of receipt.
